Online Sales Terms and Conditions of the Tatra Educational Park

I. General provisions

These Terms and Conditions set out the rules for the online sale of tickets, vouchers and other products and services offered by the Tatra Educational Park through the online sales system available on the TPE website.

The Seller and Organizer is:

operating under the brand "Tatrzański Park Edukacyjny" (Tatra Educational Park), hereinafter referred to as the "Organizer" or "TPE".

The Organizer can be contacted by e-mail at kontakt@tpe.edu.pl or by phone at 797 378 887.

Online sales are conducted using an e-commerce widget provided and technically operated by Berg Regions Sp. z o.o.

Online payments are processed via the external payment operator Autopay.

Using the online sales system constitutes acceptance of these Terms and Conditions.

Before making a purchase, the Customer is required to read these Terms and Conditions, the TPE Park Rules, and the information regarding the selected ticket, voucher, product or service.

II. Definitions

  • TPE / Park — the Tatra Educational Park operated by PARK ODSKOCZNIA Sp. z o.o.
  • Organizer / Seller — PARK ODSKOCZNIA Sp. z o.o., operating under the brand Tatra Educational Park.
  • Customer — a natural person, legal person or organizational unit making a purchase through the online sales system.
  • Online sales system / Widget — the tool enabling the purchase of TPE tickets, vouchers and other products and services over the Internet.
  • Ticket — a document in electronic form, a QR code, a PDF file, or another form of confirmation entitling the holder to use the selected TPE service.
  • Voucher — a document in electronic form entitling the holder to use a specific TPE service, product or offer in accordance with the conditions indicated at the time of purchase.
  • Order — an action performed by the Customer in the online sales system, leading to the purchase of the selected product or service.
  • Park Rules — the Terms and Conditions for the Use of the Tatra Educational Park.

III. Offer and prices

In particular, entrance tickets, family tickets, discounted tickets, vouchers, educational packages, date reservations, and other products and services available in the current TPE offer may be sold through the online sales system.

Detailed information regarding a given product or service, including the price, scope of the service, delivery date, validity of the ticket or voucher, and any restrictions, is provided with the given product in the online sales system.

Prices given in the online sales system are gross prices and include applicable taxes, unless stated otherwise.

The Organizer reserves the right to change prices, the offer, product availability and dates, provided that such changes do not affect orders paid for before the changes were introduced.

The number of tickets, vouchers or places for selected services may be limited.

IV. Placing orders

A purchase in the online sales system requires selecting a product or service, providing the data necessary to fulfil the order, accepting the required terms and conditions, and making payment.

The Customer is required to provide true and current data necessary to handle the order.

The Organizer is not liable for the inability to deliver the ticket, purchase confirmation or order-related information if the Customer provided an incorrect e-mail address, phone number or other incorrect data.

The sales contract is concluded at the moment the Customer successfully pays for the order and the transaction is confirmed by the online sales system.

After making the payment, the Customer receives a purchase confirmation and a ticket, voucher, QR code, PDF file, or another form of document entitling them to use the purchased service.

The purchase confirmation is sent to the e-mail address provided by the Customer when placing the order.

V. Payments

Payments for orders placed in the online sales system are processed using the available payment methods indicated in the system.

Online payment processing is carried out by the external payment operator Autopay.

The Organizer does not store the Customer's full payment card data or their online banking login credentials.

An order that is unpaid or not confirmed by the payment operator may be automatically canceled.

In the event of payment problems, the Customer should contact the Organizer, or, if the problem directly concerns the payment, the payment operator.

VI. Fulfilment of the ticket, voucher or service

A ticket, voucher or other document purchased online must be presented at the entrance to TPE or at another place indicated by the Organizer.

The ticket may be presented in electronic form, on the screen of a mobile device, or in printed form, unless stated otherwise for a given product.

The Organizer may refuse to honor a ticket if the ticket is invalid, has already been used, is illegible, damaged, altered, or if there is a reasonable suspicion of its unauthorized use.

The ticket entitles the holder to use the service in accordance with its type, date, scope and conditions indicated at the time of purchase.

If a ticket, voucher or service is valid on a specific day, date or period, the Customer is required to use it within that period.

Failure to use the ticket, voucher or service within the specified period for reasons attributable to the Customer does not constitute grounds for a refund.

Purchasing a ticket does not guarantee the ability to see all animals or to take part in all activities at every moment of the visit. The availability of selected elements of the offer may depend on weather conditions, animal welfare, safety considerations, technical works, or decisions made by TPE staff.

Use of TPE takes place in accordance with the Terms and Conditions for the Use of the Tatra Educational Park.

VII. Discounted, family and special tickets

A Customer using a discounted, family, promotional or other special ticket should meet the conditions indicated for the given ticket or in the current price list.

The Organizer may request that a document confirming the right to the discount, promotion or special ticket be presented.

If no document confirming eligibility for the discount is provided, the Organizer may refuse to honor the discounted ticket or may request payment of the difference to the applicable full-price ticket.

VIII. Refunds and withdrawal from the contract

In accordance with applicable law, the Customer is not entitled to withdraw from a distance contract in the case of the purchase of services related to leisure, entertainment, educational, sports or cultural events, if the contract specifies a day or period for the performance of the service.

Tickets, vouchers, reservations and other services purchased for a specific day, time, date or period are not refundable due to the Customer's cancellation, lateness, change of plans, failure to use the ticket, or failure to use the service for reasons attributable to the Customer.

The inability to see a specific animal, a temporary limitation in the availability of a selected attraction, or a change to the schedule of talks or shows, where this results from animal welfare, weather conditions, safety considerations, or the Park's current organization of work, does not constitute grounds for a refund of the ticket price.

A refund may be considered in special cases, in particular where:

  • the service was not performed for reasons attributable solely to the Organizer,
  • the Organizer canceled the event, service or date, and the Customer did not make use of the proposed alternative date,
  • the Customer's account was charged twice,
  • an obvious technical error occurred in the online sales system.

Each refund case is considered individually upon being reported by the Customer.

If a refund is deemed justified, it is generally made using the same payment method the Customer used for the purchase, unless the parties agree otherwise or the payment operator requires a different method of processing the refund.

The provisions of this section do not limit the Customer's right to file a complaint if the service was not performed or was performed improperly.

IX. Complaints

The Customer has the right to file a complaint regarding the purchase, the operation of the online sales system, payment, the ticket or voucher received, or the performance of the service.

Complaints may be submitted electronically to: kontakt@tpe.edu.pl.

The complaint should include:

  • the Customer's first and last name,
  • the e-mail address used for the purchase,
  • the order number, ticket number, QR code, or other data enabling the transaction to be identified,
  • the date of purchase,
  • a description of the matter and the reason for the complaint,
  • in the case of payment issues — proof of payment or the transaction number, if the Customer has it.

The Organizer reviews the complaint within 30 days of its receipt.

A response to the complaint will be sent to the e-mail address provided by the Customer.

If additional information is needed to review the complaint, the Organizer may ask the Customer to provide additional data or documents.

X. Liability

The Organizer is responsible for the proper performance of the services offered by TPE in accordance with the scope of the purchased ticket, voucher or product.

The Organizer is not liable for the inability to fulfil an order if this results from the Customer providing incorrect data, lack of access to their e-mail inbox, the operation of anti-spam filters, technical problems on the Customer's side, or incorrect use of the online sales system.

The Organizer is not liable for interruptions or difficulties arising from the operation of the payment operator, external systems, Internet providers, failures beyond the Organizer's control, or force majeure.

The Organizer reserves the right to temporarily change opening hours, the activity schedule, the availability of selected parts of the Park, or the performance of specific activities due to weather conditions, animal welfare, technical works, safety considerations, or other circumstances beyond the Organizer's control.

A Customer using a ticket or service is required to comply with the Terms and Conditions for the Use of the Tatra Educational Park.

XI. Personal data

The controller of Customers' personal data is PARK ODSKOCZNIA Sp. z o.o., operating under the brand Tatra Educational Park.

Customers' personal data is processed for the purpose of handling online sales, fulfilling orders, generating tickets or vouchers, processing payments, handling complaints, settlements, and any defense or pursuit of claims.

Technical maintenance of the online sales system is carried out by Berg Regions Sp. z o.o., which processes personal data as a processor acting on behalf of the Organizer.

Online payments are handled by the external payment operator Autopay.

Detailed rules for the processing of personal data are set out in the Online Sales Privacy Policy of the Tatra Educational Park.

XII. Final provisions

In matters not regulated by these Terms and Conditions, the generally applicable provisions of Polish law shall apply.

The Organizer reserves the right to amend these Terms and Conditions, in particular in the event of changes to the law, changes to the way the online sales system operates, a change of payment operator, or changes to the offer or the manner of providing services.

Changes to these Terms and Conditions do not affect the rights of Customers arising from orders placed and paid for before the changes take effect.

The current version of these Terms and Conditions is available on the TPE website and in the online sales system.

These Terms and Conditions are in effect from the date the online sales system is launched.
